Updated pamphlet helps districts understand, meet their ESY obligations

LRP Media Group, a recognized leader in the special education publishing industry, has released an update of Extended School Year Services Under the IDEA and Section 504: Legal Standards and Case Law. The 2021 version includes substantial new discussion and analysis, as well as coverage of 30 new cases and policy guidance documents concerning ESY requirements under the Individuals with Disabilities Education Act, Section 504 of the Rehabilitation Act of 1973, and the ADA Amendments Act of 2008.

The updated Extended School Year Services pamphlet covers a variety of new topics, including districts’ obligations to develop and implement ESY programming during extended emergency school closures. The updated pamphlet also includes full text of several important ESY case decisions and nine sample forms and tools.

“One of the strengths of the updated pamphlet is how broad it is,” said Joseph L. Pfrommer, Esq., legal editor at LRP. “From eligibility to placement to avoiding discrimination, this pamphlet covers all the major ESY issues IEP teams and district administrators should know to provide appropriately individualized ESY programming and minimize disputes.”

The 2021 update also helps districts to:

  • Comply with ESY obligations for students learning remotely.
  • Determine ESY eligibility utilizing the “regression-recoupment” standard.
  • Avoid discriminating against students with disabilities when making decisions about ESY or when implementing it.
  • Determine an appropriate placement and setting for ESY.
  • Develop an ESY program that addresses a student’s unique needs.

Extended School Year Services Under the IDEA and Section 504: Legal Standards and Case Law is available for purchase from LRP Publications’ online store.
